But on the back of my VH ticket stubs from this summer, there is an exculpatory clause that reads, "Holder voluntarily assumes all risk and danger incidental to the event for which this ticket is issued, whether occurring prior to, during, or after the same." I believe that this clause will be put to the "reasonable person test." That is, would a reasonable person expect very loud volume levels at a rock concert. Any answer other than yes, of course, is ridiculous. The fact that hearing was lost by *one* person is inconsequential (IMHO) because of the exculpatory clause. Well, yesterday wasn't over yet when I sat down to compose a little email and it seems that when I stepped aside to let MULLY add his comments I fell the fuck asleep. Man, I musta been seriously ragged, 'cause the last thing I remember I was talking to MULLY and then, suddenly, I was being shaken awake and MULLY was making my bed and tucking me in. Nothing will make you question your sense of reality like having MULLY fluff your pillow, pull up your covers and ask you if you need a night-light. ;-) Yesterday was fucking phenominal, though. MULLY's wife has been nothing short of amazing and the fish she served me with brown rice for breakfast was one of the best meals I can remember. I know I'm an imposition, but you'd never know it by the way she treats me. After I got dressed, we ran over to a Cafe owned by a friend of MULLY's that's all decked out in 60's memorabilia. The place is great and the owner was totally cool. He made me a bright pink cream soda float with three scoops of ice cream perched on top of ice in the beverage so it doesn't melt and make that nasty dairy oil slick that you get in most floats. We were talking about 60's bands and MULLY told him that I was into the Dead. He insisted on giving me a very cool Japanese Jerry Garcia tribute poster. Then it was off to visit Shachou, MULLY's friend who owns a music store. He has a lot of great stuff (50's Fender amps, ancient Strats, Plexi Marshalls, Tube Screamers...all kinds of stuff) at his shop and we just hung out with him for hours talking about music. Everyone played a lot on a lot of different gear and I had a lot of fun. Again, I couldn't get out of the store without accepting gifts. Then we visited a guy MULLY knows who runs a Deadhead shop. He actually closed up his shop and we sat around and partied pretty hard until the sun went down. He pulled out all kinds of cool posters and insisted I take them with me. It's been really amazing to be here. You wouldn't believe how nice the people are. Everywhere I've gone people have given me gifts or extended hospitality to me in some kind and thoughtful way. It's really nice here. Jim has some great friends. One of those friends was cool enough to pick me up a killer Cuetec cue and Joe Porper case before I showed up and MULLY had replaced the tip with a Mori tip and picked me up a glove so that I had an amazing rig waiting when I got here. We spent the late hours of last night at his favorite pool hall and he taught me more in the span of those hours over the table than I've learned in 25 years of practice and swearing. The fucker even sunk some impossible shots (including a thought-controlled masse shot) while I bumbled around the table. When I jumped the 4-ball off the table nearly killing a giggling Japanese cutie I decided it might be time to pack it in. By the time we rolled in here last night I was speechless from the events of the day. I sat on the tatami (straw flooring) and had all kinds of thoughts rolling around in my head when it appears my circuit breakers tripped and the snoring began. ;-) Japan '98 has started off with a fucking bang. It's hard to believe it was only the first day of the trip.
